Terms of Service

ConstruMate is a cloud-based SaaS platform that enables construction professionals to create project estimates, generate PDF proposals, manage client portals, schedule labor, and collect payments online.

We may update or improve features at any time. For material changes we will provide at least 14 days' advance notice via email or in-app notification.

You must register with a valid email address and accurate information. You must be at least 18 years old and have legal authority to enter this agreement on behalf of yourself or your company.

You are responsible for maintaining the security of your credentials and all activity under your account. Notify us immediately at support@construmate.app if you suspect unauthorized access.

Access to paid features requires an active subscription. Fees are charged in advance on a recurring monthly or annual basis and are non-refundable except as required by applicable law.

Payments are processed by Stripe, Inc. By subscribing you authorize us to charge your payment method on file. Cancellation takes effect at the end of the current billing period.

We reserve the right to adjust pricing with 30 days' advance notice. Continued use after the effective date of a price change constitutes acceptance of the new pricing.

We may offer a free trial at our discretion. At the end of the trial, continued access to paid features requires an active subscription. No partial refund is given if you cancel mid-trial after a credit card has been charged.

You agree not to: (a) use the Service for any unlawful purpose; (b) upload malicious code or attempt to compromise the Service's security or infrastructure; (c) scrape or harvest data from the Service without our written consent; (d) resell, sublicense, or redistribute the Service; (e) use the Service to deceive, defraud, or harm any person.

The Service, its software, design, trademarks, and original content are owned by Portal Stav s.r.o. and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for your own internal business purposes.

You retain full ownership of all estimates, proposals, and documents you create using the Service ("User Content"). You grant us a limited license to store and process User Content solely to provide the Service to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

ConstruMate provides tools to assist in generating construction estimates; all generated documents should be reviewed by a qualified professional before presentation to clients. We do not warrant that estimates will be accurate for any specific project or jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PORTAL STAV S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the greater of (a) the total fees you paid us in the 12 months preceding the claim, or (b) EUR 100.

You may terminate your account at any time via account settings or by contacting support@construmate.app. Termination does not entitle you to a refund of prepaid fees.

We may suspend or terminate your account without prior notice if you materially breach these Terms, fail to pay applicable fees, or if required by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.

These Terms are governed by the laws of the Czech Republic. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.

Before initiating any legal proceedings, both parties agree to attempt good-faith resolution for at least 30 days. Contact us at legal@construmate.app.

We may update these Terms periodically. For material changes we will notify you by email or in-app notification at least 14 days before the effective date. Continued use of the Service after that date constitutes acceptance of the revised Terms.
